Who provides Shootspots
Shootspots is provided by MonkeyRebels (Stefan van Dockum), Rooiseheide 37G, 5481 SG Schijndel, the Netherlands. Chamber of Commerce (KvK) number: 11053393. Email: stefan@shootspots.nl.
These terms apply to your use of the Shootspots website and apps. By creating an account or using Shootspots, you accept these terms. Our privacy statement explains how we handle personal data.
The service
Shootspots is a platform where photographers share and find places to photograph (spots). You can post photos pinned to a spot, like, comment on and save posts, follow other photographers, go to events and take part in competitions.
Most of Shootspots is free. Some features are part of a paid plan (see “Paid plans”).
Your account
You must be 16 or older to create an account.
Give accurate information and keep it up to date. Keep your password secret, and tell us if you think someone else is using your account.
You may have one account. You are responsible for everything that happens through your account.
Your content
You keep the copyright in the photos and other content you post.
By posting content, you give MonkeyRebels a non-exclusive, worldwide, royalty-free licence to host, store, resize and show that content within Shootspots, and in link previews when someone shares a link to it. This licence ends when the content is removed from Shootspots. One exception: spot information you added (name, location, description and tags) stays on Shootspots without your name after you delete your account, and the licence continues for that information so it can stay available.
We do not use your content in advertising outside Shootspots without your permission.
You confirm that you have all the rights and permissions needed for what you post. This includes permission from people who are recognisable in your photos and, where required, from the owner of the property where you took them.
Rules
Do not post content that is illegal, infringes someone else's rights (such as copyright or portrait rights), is hateful, harasses others, is sexually explicit or is misleading.
Do not send spam. Do not scrape Shootspots (collect data from it automatically), try to break into it or overload it, or misuse the service in any other way.
When you visit a spot, respect the access rules, private property and your own safety and that of others.
Spot information
Spots and their details are added by users. We do not check this information and cannot guarantee that it is correct, that a place is accessible or that it is safe.
Visiting a spot is at your own risk. Always check the situation and the local rules on site.
Moderation and reporting
Report content that breaks these terms or the law through the report option in the app, or email stefan@shootspots.nl. Include a link to the content and explain why you think it is not allowed.
We review reports. We may hide content, and suspend or end accounts that break these terms. If we remove your content or restrict your account, we tell you why. If you disagree, email us.
Events
Events on Shootspots are organised by their hosts, not by MonkeyRebels. The host is responsible for the event and the information about it.
MonkeyRebels is not a party to arrangements between hosts and attendees, including tickets sold through external links.
Competitions
Competitions are organised by Shootspots or by a Pro member. A member who organises a competition is responsible for its rules and for awarding its prize. Each competition has its own rules on its competition page, for example about the period, the region, the category and the prize. Those rules apply in addition to these terms.
The jury chooses the winners, and the jury's decision is final. Prizes are as described on the competition page.
Paid plans
Shootspots offers paid plans: Pro for photographers, Pro+ for photographers who host more (unlimited events and competitions, a portfolio page) and Premium for a spot. Prices are shown on the pricing pages and include VAT where applicable.
Plans are monthly subscriptions. The payment is collected automatically every month through Mollie.
You can cancel at any time in Settings. Your benefits then continue until the end of the period you have paid for. We do not refund partial periods, except in the case below.
If you are a consumer, you may withdraw from a subscription within 14 days of taking it out, without giving a reason. Because the service starts immediately at your request, you then pay for the part of the service already provided. To withdraw, email stefan@shootspots.nl.
If a renewal payment is late, your benefits continue for up to 14 days while we wait for the renewal payment. If it still hasn't succeeded after that, the subscription expires and your benefits end. You can subscribe again at any time.
We announce price changes at least 30 days in advance. You can cancel before the new price applies.
By buying Premium for a spot, or claiming a spot with Pro, you confirm that you are entitled to represent that place, for example as its owner or manager. If you are not, we may remove your edit rights for the spot.
Advertising
Shootspots shows sponsor banners and may show Google ads between the posts in the feed. Pro members are not shown Google ads. Our privacy statement explains how ads use data.
Availability and changes to the service
We do our best to keep Shootspots available, but we cannot guarantee that it always works without interruptions or errors.
We may carry out maintenance and change, add or remove features.
Liability
Our liability to you is limited to the amount you paid us in the 12 months before the event that caused the damage. We are never liable for indirect or consequential damage, such as lost profit or lost data.
These limits do not apply in case of intent or gross negligence on our part, or where the law does not allow liability to be limited.
Ending your account
You can delete your account at any time in Settings. Doing so ends any running Pro, Pro+ or Premium subscription immediately, including the rest of a period you have already paid for.
We may suspend or end your account if you seriously or repeatedly break these terms.
Changes to these terms
We may change these terms. We announce material changes in advance, on Shootspots or by email. If you do not agree with a change, you can delete your account before it takes effect.
Applicable law and disputes
Dutch law applies to these terms and to your use of Shootspots. If you are a consumer living in another EU country, you keep the protection of the mandatory rules of that country.
Disputes are brought before the Rechtbank Oost-Brabant (District Court of East Brabant), unless mandatory consumer law gives you the right to go to another court.
If you have a problem, please contact us first so we can look for a solution together.
